These Terms and Conditions ("Agreement") govern the Avia Electrical Protection Plan ("Plan") offered by Avia Electrical Solutions ABN 95 365 807 408, REC 37933 ("Avia Electrical", "we", "us", "our"), a licensed electrical contractor operating in Victoria, Australia.
By subscribing to the Plan, you ("Subscriber", "you", "your") agree to be bound by this Agreement in its entirety. If you do not agree, do not subscribe.
This Agreement is governed by the laws of Victoria, Australia. Any dispute shall be subject to the exclusive jurisdiction of the courts of Victoria.
Your subscription entitles you to the following services once per subscription year (12 consecutive months from your sign-up date) across all registered properties or premises. Inclusions differ between the Residential Plan and Commercial Plan as set out below.
**— RESIDENTIAL PLAN —**
A qualified, licensed electrician will conduct a general safety inspection of the electrical installation at each registered property. This includes a visual inspection of the switchboard, accessible power points, light fittings, and safety switches. It does not include invasive testing, opening of walls, roof or subfloor inspections, or the repair or replacement of any components found to be defective. Any rectification work identified during the inspection will be quoted separately at standard hourly rates.
We will test all smoke alarms at each registered property, clean them of dust and debris, and replace standard 9V or AA batteries. This service covers battery-operated and 240V smoke alarms accessible from floor level with a standard ladder. It does not cover: hardwired interconnected alarm system faults, alarm replacement where a unit has failed end-of-life (replacement quoted separately), or alarms installed in locations not safely accessible.
We will clean the filters, wash accessible components, and perform a general operational check on all split system air conditioning units at each registered property. This service covers: filter removal and washing, accessible coil wipe-down, and a functional run-test. It does not cover: refrigerant recharging or leak detection, compressor faults or repairs, electrical faults within the outdoor unit, warranty repairs, or any mechanical component replacement. Any faults identified will be quoted separately.
You are entitled to one urgent electrical callout per subscription year. This entitles you to a callout visit by a licensed electrician to diagnose an urgent electrical fault at a registered property. The callout covers: travel to site and up to one (1) hour of diagnostic time. Any repair work, parts, or additional labour beyond the included one-hour diagnostic period will be quoted on-site and invoiced separately at our standard rates. This entitlement cannot be carried over to the following subscription year. "Urgent" is defined as an active electrical fault posing a safety risk — it does not cover cosmetic issues, general maintenance requests, or new installation work.
**— COMMERCIAL PLAN —**
A licensed electrician will conduct a general safety inspection of the electrical installation at each registered premises and provide a written compliance report. This service covers single-storey premises up to 300m² of floor area per site. Premises exceeding 300m², multi-storey buildings, or sites requiring additional access arrangements will be quoted separately. The inspection is visual in nature and does not include invasive testing, opening of walls, or repair work. Any rectification identified will be quoted separately.
We will test and tag up to 25 portable electrical appliances, power leads, and extension cords per registered premises in accordance with AS/NZS 3760. Items include hand tools, power boards, and portable equipment accessible at the time of visit. Items requiring specialist access, items not present at the time of the visit, and any items beyond the 25-item limit will be quoted separately at our standard per-item rate. Failed items will be tagged out of service; replacement or repair is quoted separately.
We will conduct an infrared thermal imaging scan of one (1) main switchboard per registered premises to identify hot spots, loose connections, and potential fault conditions. Sub-boards, distribution boards, and any additional switchboards beyond the main board are not included and will be quoted separately. A written report of findings will be provided. No repair work is included; identified faults will be quoted separately.
We will test up to 8 residual current devices (RCDs/safety switches) per registered premises and provide a written record of test results. Testing is conducted in accordance with AS/NZS 3017. RCDs in excess of 8 per site will be quoted at a standard per-device rate. Any RCD found to be faulty will be flagged and replacement quoted separately.
We will test and certify up to 10 emergency and exit light fittings per registered premises in accordance with AS 2293. A 6-monthly interim test is also included within the subscription year. Fittings in excess of 10 per site will be quoted at a standard per-fitting rate. Fittings requiring specialist access equipment (beyond a standard 3m ladder) will be quoted separately. Any failed fittings will be flagged; replacement or repair is quoted separately.
We will conduct a lux level measurement check in up to 4 defined areas per registered premises to assess compliance with AS/NZS 1680 minimum workplace lighting standards. A written record of results will be provided. Areas in excess of 4, or areas requiring specialist measurement equipment, will be quoted separately. This service identifies non-compliance only; any remediation work will be quoted separately.
We will visually inspect and operationally verify the condition of installed surge protection devices (SPDs) at each registered premises. This service covers devices installed and accessible at the switchboard. It does not include the supply or installation of new SPDs; any SPD found to be degraded or failed will be quoted for replacement separately.
As per Clause 2.4 above, applicable to registered commercial premises. The callout covers travel to site and up to one (1) hour of diagnostic time. Any repair work, parts, or additional labour beyond the included one-hour diagnostic period will be quoted on-site at our standard commercial rates.
The following are expressly excluded from the Plan and will be quoted and invoiced separately:
- Any repair, replacement, or installation work beyond the scope defined in Section 2 - New electrical work of any kind (new circuits, power points, lighting, etc.) - Switchboard upgrades or component replacement - Rewiring of any part of the property or premises - Faults caused by third-party interference, DIY electrical work, or storm/flood damage - Insurance work or warranty claims - Properties or premises outside of the greater Melbourne metropolitan area - Sites added after the annual service window has opened for your account - Any service requested more than once in a subscription year - Emergency callouts in excess of the one (1) annual entitlement
- Refrigerant services for split systems - Roof or subfloor electrical inspections - Commercial, industrial, or strata-managed properties
- Test & Tag items in excess of 25 per site per year - Thermographic scanning of sub-boards or additional switchboards beyond the main board - RCD testing in excess of 8 devices per site - Emergency and exit lighting fittings in excess of 10 per site - Emergency lighting fittings requiring access equipment beyond a standard 3m ladder - Lux level checks beyond 4 defined areas per site - Supply or installation of surge protection devices - Premises exceeding 300m² floor area (inspection scope to be agreed separately) - Multi-storey premises (quoted separately based on access requirements) - Residential properties (covered under the Residential Plan only) - Strata-managed buildings where common area access is restricted - Any compliance certification beyond what is stated in Section 2 - Refrigerant, HVAC mechanical, or BMS system work of any kind
All services included in the Plan are scheduled at Avia Electrical's discretion, subject to reasonable notice to you. We will contact you within the subscription year to arrange a suitable time. You must provide reasonable access to the property. Failure to provide access after two (2) scheduling attempts will result in forfeiture of that service for the current subscription year — no credit or refund will be issued.
Included services are not on-demand services (except the urgent callout). Annual inspections, smoke alarm checks, and split system services will be scheduled within the subscription year. We aim to complete all services within 60 days of your request or within the subscription year, whichever comes first.
Urgent callouts will be responded to within 24 hours on business days (Monday–Friday, 8am–5pm). After-hours response is at Avia Electrical's discretion and may incur additional charges beyond the included callout allocation.
All electrical work is performed by, or under the direct supervision of, a licensed electrician holding a current Electrical Worker Licence issued under the Electricity Safety Act 1998 (Vic).
Registered properties must be residential dwellings located within the greater Melbourne metropolitan area. Properties must be owned by or be the primary responsibility of the Subscriber.
Registered premises must be commercially occupied sites (offices, retail, industrial, or light manufacturing) located within the greater Melbourne metropolitan area. The Subscriber must be the owner, lessee, or authorised manager of the premises. Residential properties are not eligible under the Commercial Plan.
Sites must be registered at sign-up or by written request to Avia Electrical. Sites added mid-year will receive services pro-rated at Avia Electrical's discretion. We reserve the right to charge an additional fee for sites that materially increase the cost of service delivery, including but not limited to sites exceeding 300m² or sites with above-average appliance or fitting counts.
There is no hard cap on the number of sites per subscription. However, Avia Electrical reserves the right to review and renegotiate pricing where a Subscriber has more than four (4) sites registered, or where any single commercial site materially exceeds the service limits set out in Section 2.
If you sell, vacate, or cease operating from a registered site, you must notify us in writing within 14 days. Services completed at a site prior to notification remain valid and non-refundable.
Current subscription fees are as follows (all amounts inclusive of GST):
Residential Annual Plan: $329.00 AUD per year, billed upfront annually. Residential Monthly Plan: $33.95 AUD per month, billed monthly. 12-month minimum commitment applies. Commercial Annual Plan: $749.00 AUD per year, billed upfront annually. Commercial Monthly Plan: $75.99 AUD per month, billed monthly. 12-month minimum commitment applies.
THIS IS A RECURRING SUBSCRIPTION THAT RENEWS AUTOMATICALLY.
Your subscription will automatically renew at the end of each billing period (monthly or annually, as selected) at the then-current subscription fee. Your nominated payment method will be charged automatically on each renewal date without further notice, unless you cancel in accordance with Section 7.
For annual plans, Avia Electrical will send you a written renewal reminder to your registered email address at least 14 days before each annual renewal date, including the amount to be charged and the renewal date. This reminder satisfies Avia Electrical's obligation under the Australian Consumer Law and ACCC subscription service guidelines.
For monthly plans, your subscription renews automatically each month. No individual renewal reminders are sent for monthly renewals; by subscribing you acknowledge and consent to the ongoing monthly charge.
All monthly plans carry a 12-month minimum commitment. By subscribing to a monthly plan, you agree to pay all 12 monthly instalments. Early cancellation does not relieve you of your payment obligation for the remaining months in the current 12-month term. Avia Electrical reserves the right to invoice for the outstanding balance of the minimum term upon early cancellation. After the 12-month minimum term, the subscription continues on a month-to-month basis and may be cancelled with 30 days' written notice.
Payments are processed securely via Stripe. Avia Electrical does not store your card details. By subscribing, you expressly authorise Avia Electrical Solutions (ABN 95 365 807 408) to charge your nominated payment method on a recurring basis (monthly or annually as selected) at the applicable subscription fee on each renewal date, until the subscription is cancelled in accordance with Section 7.
If a payment fails, your subscription will enter a grace period of 7 days. If payment is not received within the grace period, your subscription will be suspended and you will lose access to scheduled services. Suspended subscriptions may be reactivated upon successful payment. The minimum term commitment continues to apply during any suspension period.
Avia Electrical reserves the right to adjust subscription fees with 30 days' written notice sent to your registered email address. If you do not wish to continue at the new price, you may cancel before the new rate takes effect in accordance with Section 7. Price changes do not affect the minimum term obligation on monthly plans already in progress.
All prices are quoted inclusive of GST (Goods and Services Tax) as required under the A New Tax System (Goods and Services Tax) Act 1999 (Cth).
You may cancel your subscription at any time by sending a written cancellation request to admin@aviaelectrical.com.au with at least 30 days' notice before your next renewal date. Cancellation takes effect at the end of the current billing period following the 30-day notice period. You will continue to receive services and be charged until the cancellation takes effect. No partial-period refunds are issued.
To be clear: if your next renewal date is 1 September and you request cancellation on 15 August (less than 30 days' notice), your subscription will be renewed on 1 September and cancellation will take effect on 1 October.
You may also cancel through the Stripe Customer Portal accessible via your member account at aviaelectrical.com.au/portal.
Monthly subscribers in their initial 12-month minimum term may request cancellation at any time, but remain liable for all monthly payments due for the remainder of the 12-month term. Avia Electrical will issue a final invoice for the outstanding balance upon cancellation request. After the 12-month minimum term, monthly subscriptions may be cancelled with 30 days' written notice as per Clause 7.1.
Services delivered prior to cancellation are non-refundable. If you cancel after having received services in the current subscription year, no refund will be issued for the value of those services.
Avia Electrical reserves the right to cancel any subscription with 14 days' written notice if: (a) we are unable to service your area; (b) you have provided false or misleading information; (c) you have engaged in abusive or threatening behaviour toward our staff; or (d) your account has been in arrears for more than 30 days. In such cases, a pro-rata refund for the unused portion of the current paid period will be issued.
In accordance with the Australian Consumer Law, you have a 14-day cooling-off period from the date of your first payment. You may cancel within this period for a full refund, provided no services have been delivered during that period. To exercise this right, email admin@aviaelectrical.com.au within 14 days of your first charge with the subject line "Cooling-Off Cancellation".
Outside the 14-day cooling-off period, subscription fees are non-refundable except where required by the Australian Consumer Law. Nothing in this Agreement limits any right you may have under the Australian Consumer Law that cannot be excluded.
To the maximum extent permitted by applicable law, Avia Electrical's total liability to you under or in connection with this Agreement shall not exceed the total subscription fees paid by you in the 12 months preceding the claim.
Avia Electrical is not liable for any indirect, incidental, special, or consequential loss or damage arising out of or in connection with the Plan, including but not limited to: loss of income, property damage not directly caused by our negligence, or equipment failure.
Nothing in this Agreement excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by any legislation that cannot lawfully be excluded, including the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).
Avia Electrical is not liable for any damage, loss, or fault arising from pre-existing defects, improper prior installations, or building defects that are discovered during the delivery of included services. We will notify you of any such findings.
Avia Electrical collects and holds your personal information (name, contact details, date of birth, property addresses) for the purpose of delivering the Plan and administering your account. This information is handled in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy.
Your information will not be sold to third parties. It may be shared with our payment processor (Stripe) and, where required, with regulatory bodies. You have the right to access and correct your personal information at any time by contacting admin@aviaelectrical.com.au.
This Agreement constitutes the entire agreement between you and Avia Electrical in relation to the Plan and supersedes all prior representations, negotiations, or understandings.
Avia Electrical may amend these Terms at any time with 30 days' written notice. Continued use of the Plan after notice constitutes acceptance of the amended Terms.
Failure by Avia Electrical to enforce any provision of this Agreement does not constitute a waiver of that provision.
If any provision of this Agreement is found to be unenforceable, it will be severed and the remaining provisions will continue in full force.
